EPA Announces November 4 Public Hearing on Renewable Fuel Standard Proposal

The U.S. Environmental Protection Agency (EPA) has scheduled a virtual public hearing for November 4, 2026, to gather stakeholder The U.S. Environmental Protection Agency (EPA) has scheduled a virtual public hearing for November 4, 2026, regarding its proposed reallocation of 770 million Renewable Identification Numbers (RINs) associated with small refinery exemptions (SREs) under the Renewable Fuel Standard (RFS).

The proposal follows EPA’s August 31 announcement of decisions on 34 exemption petitions for the 2025 compliance year, including 18 full exemptions, 11 partial exemptions, three denials, and two petitions determined to be ineligible.

The approved exemptions represent approximately 1.76 billion RINs, exceeding EPA’s previous estimates by 770 million RINs.

EPA Considering Two Approaches

  • Option 1: Reallocate 385 million RINs to each of the 2026 and 2027 compliance years.
  • Option 2: Reallocate all 770 million RINs to the 2027 compliance year.

The proposed rule is part of EPA’s ongoing administration of the RFS, which establishes annual renewable fuel volume requirements for transportation fuels in the United States.

Key Dates

  • October 28: Virtual hearing registration deadline
  • November 4: EPA virtual public hearing
  • December 4: Written public comment deadline
