Final 2026-2027 RFS Rule Enters Home Stretch

On February 25, the Environmental Protection Agency transmitted the Final 2026-27 “Set 2” Renewable Fuel Standard rule to the White House Office of Management and Budget for interagency review – a final step in the RFS rulemaking process. The transmittal was confirmed by EPA Assistant Administrator for Air and Radiation Aaron Szabo at the National Ethanol Conference.

In response to Clean Fuels’ lawsuit against EPA over the missed deadline for the 2026 RFS rule (which was originally due in November 2024), the agency has promised to finalize the RVOs by March 31. EPA is scheduled to provide another update to the Court on its rulemaking progress by Monday, March 2.

The OMB review process allows stakeholders to request meetings with the agencies and reiterate comments and concerns made on the proposed rule. Clean Fuels met with OMB in June, after the proposed rule was announced, to emphasize the need for timely, robust RVOs consistent with the industry’s capacity and investments and the availability of feedstocks. Clean Fuels asked EPA to set biomass-based diesel volumes for 2026 at a minimum of 5.25 billion gallons and to ensure the volumes were not eroded by small refinery exemptions. Clean Fuels provided comments in November to support EPA’s proposed supplemental volumes reallocating recent exemptions.

Clean Fuels in coordination with our RVO Working Group will again request a meeting with OMB to ask that the rule be finalized quickly and published in the Federal Register before the end of March in order to maintain compliance deadlines and provide certainty for all stakeholders.
